BALC CLE REGISTRATION FORM

“BRIDGE THE GAP” PROGRAM FOR NEWLY ADMITTED LAWYERS
SCHEDULED FOR JULY 10TH

The Bar Association of Lehigh County, sponsor of the Pennsylvania Supreme Court’s “Bridge the Gap” CLE program for newly admitted lawyers, announces that it will be presenting the program once again at Bar Association headquarters at 1114 Walnut Street in Allentown on Thursday, July 10, 2008, from 12:30 PM to 5:00 PM.

In 2002, the Supreme Court of Pennsylvania approved a rule change requiring newly admitted lawyers to complete the “Bridge the Gap” program by the end of their first compliance deadline.  This four hour program, revised in 2005 and again in 2008 to provide updated content and to focus on changes in the Rules of Professional Conduct, contains information to assist newly admitted lawyers in the transition from law student to attorney.

Approved for four hours of Ethics Credit, the program will be provided by BALC at a cost of $10.00 to any newly admitted attorney.  The program is open to all lawyers.  The cost to attorneys practicing two years or longer who have an interest in attending is $90.00.

An important part of a lawyer’s work involves counseling, guiding and leading clients to best outcomes.  Among the ways we perform this role is by referring clients to other professionals and service providers.  One area where many clients look to their lawyer for guidance and insight is in thinking about how to manage their financial affairs.  This seminar will broaden your expertise in evaluating financial advice and the people who sell it. And for No Extra Charge, we will give you valuable insights into your own financial decision making.  In this one hour Ethics Credit seminar, Attorney Blum will cover:

The different ways that financial advisors are regulated (or aren’t regulated)
What duties financial advisors have to clients including which ones are held to a fiduciary duty and which            are not
Consideration of a lawyer’s duties to a client when giving advice that could be considered “financial                     advice”
Economic truths that can guide you in thinking about financial advice
The problem of conflicts-of-interest and how to evaluate financial advisors in light of it
Thoughts on professionalism as it relates to our role as lawyers.

Steven G. Blum is a lawyer, teacher and consultant.  He holds the degrees of Masters of Laws and Juris Doctor.  He also earned a Masters Degree in Education from Harvard.  He has led seminars for a number of Fortune 100 companies as well as workshops for physicians, lawyers, accountants, executives and other professionals.  Mr. Blum teaches at the Wharton School of Business of the University of Pennsylvania, and has lectured frequently at Wharton’s Aresty Institute of Executive Education.  In addition, he is a visiting professor at the Athens Laboratory of Business Administration in Greece.  He is also managing partner of Steven G. Blum and Associates LLC.  His book on economics, personal finance and professional ethics is expected to be released later this year.

Litigation is a fact of life for most organizations.  E-discovery is the latest technique for the gathering of evidence in litigation where electronic forms of evidence are involved.  This presentation will assist an organization in understanding the steps necessary to comply with an E-discovery order, how to gather electronic evidence, and when it is appropriate to call in forensic experts for assistance.  Also covered will be the importance of having destruction policies in place and why it is critical that destruction policies are strictly enforced across the organization.

Presenter Angie singer Keating is a co-founder of Reclamere, Inc., a security focused I.T. asset management and data recovery company servicing Fortune 1000 as well as SMB accounts.  She has a broadly diversified background with over 18 years of experience in engineering, project management and regulatory compliance.  Her keen analytical and research abilities are necessary at Reclamere for the development of new service offerings such as data recovery, hard drive sanitization auditing, hard drive screening, and desktop systems preparation and deployment.
Keating is a graduate of the Pennsylvania State University, Altoona campus, in Electrical Engineering Technology.  She resides in Altoona with her husband Douglas, a Special Deputy Assistant District Attorney, and 10 year old son, Sammy.

10th Annual Auto Negligence Law Update

BALC is pleased to announce Attorney Mark Altemose, a Board Certified Civil Trial Attorney and Partner with Cohen & Feeley in Bethlehem, who in May won a $4.36 million construction accident verdict in Northampton County with his partner, Kelly Clifford Rambo, will be returning for the 10th year to present a seminar on important new developments in Auto Negligence Law.

His seminar will include: (1) UM/UIM claims, the PA Supreme Court’s dramatic reversal of itself upon motion for reconsideration in Sackett v. Nationwide, new decisions regarding the validity of the household and regularly used non-owed vehicle exclusions, new decisions regarding stacking of fleet policies, and new insurance policy arbitration clauses provisions following IFP v. Koken; (2) Medicare, DPW and Child Support liens, including the applicability of liens to minor’s claims; (3) Sovereign Immunity, including the proof required to establish a permanent loss of use of a body function; and (4) The applicability of Section 1797 of the MVFRL to claims for future medical expenses in auto negligence cases.  Mark will also discuss strategies to increase damages and limit the percentage allocation of comparative negligence to the Plaintiff where Plaintiff’s negligence is clear in all personal injury cases.

The Nuts and Bolts of Medicaid Planning

Medicaid is the primary funding source for nursing home care.  Unfortunately, for most nursing home residents and their spouses, impoverishment is the price of admission into the Medicaid program.  Today, lawyers and clients alike are less inclined to accept spousal impoverishment and/or forfeiture of the family inheritance as a necessary pre-requisite to Medicaid eligibility.  In this course, you will examine the fundamentals of Medicaid planning, when it makes sense to advise that your clients engage in it and how to navigate through the process.  Plenty of practice tips will be offered.

Permitting Land Development Projects

Permitting land development projects can be a daunting task.  As an attorney you are challenged to work with, not only the developer/client, but also with numerous other professionals and agencies to complete all necessary legal work so that the project can be built.  However, the work is becoming more onerous and requires a substantial understanding of the roles of the agencies and engineers in the process.  Course presenter Bernard M. Telatovich, P.E., Esq. is a licensed attorney and professional engineer.  He is a partner in the firm of Benchmark Civil Engineering Services, Inc.  Along with Peter Terry, P.E., P.T.O.E., President of Benchmark, they will discuss the roles and tasks of the attorney and engineer in the PENNDOT Highway Occupancy Permit (HOP) process, recent changes in the MUTCD that may have a substantial impact on not only proposed developments, but also existing developments, and the state of the NPDES permit.  Continuous regulatory changes have created numerous hoops to jump through such that a coordinated effort of all professionals is necessary to more effectively meet the client/developer’s expectations.

Mr. Telatovich is an attorney in Florida and Pennsylvania and is licensed as a professional engineer in Florida, New York and Pennsylvania.  He is the PSE’s 2007 “Engineer of the Year” in the Lehigh Valley.  Along with being the Vice President of Land Development for Benchmark, he is the President of Consulting Services and Investigations, LLC, a forensic engineering firm in Bethlehem.  Mr. Terry is founder and president of Benchmark Civil Engineering Services.  He is a licensed professional engineer in New Jersey, New York and Pennsylvania.  He is currently a Region 2 Governor with the American Society of Civil Engineers and has taught transportation engineering as adjunct faculty at both Lafayette College and Lehigh University.  Since starting Benchmark in 1994, his primary practice has focused on traffic engineering and PennDOT permitting.
