THE COURT: ON BEHALF OF THE JUDGES OF THE COURT OF COMMON PLEAS, I’D LIKE TO WELCOME
YOU TO THIS ANNUAL CEREMONY JOINTLY PRESENTED BY THE LEHIGH COUNTY BAR ASSOCIATION AND THE COURT. THIS IS OUR ANNUAL SPECIAL SESSION OF BAR MEMORIALS TO RECOGNIZE THE MEMORY AND HONOR THE MEMORY OF THOSE MEMBERS OF OUR ASSOCIATION WHO PASSED AWAY DURINGTHE PREVIOUS YEAR.
THE COURT RECOGNIZES JOSEPH HOLKO, ESQUIRE, PRESIDENT FROM THE LEHIGH COUNTY BAR.
MR. HOLKO: MAY IT PLEASE THE COURT, PRESIDENT JUDGE PLATT, THE HONORABLE JUDGES OF THE
COURT OF COMMON PLEAS OF LEHIGH COUNTY, MEMBERS OF THE BAR, FAMILY, FRIENDS AND COLLEAGUES OF DANNY KHALOUF. ON BEHALF OF THE BAR ASSOCIATION OF LEHIGH COUNTY, GOOD MORNING.
WELCOME TO ONE OF THE FINEST TRADITIONS OF THIS COURT AND OUR BAR ASSOCIATION. EACH YEAR,
SINCE 1905, WE HAVE GATHERED TO HONOR AND PAY TRIBUTE TO THOSE MEMBERS OF OUR ASSOCIATION WHO PASSED AWAY THE YEAR BEFORE. I WOULD LIKE TO THANK PRESIDENT JUDGE PLATT AND ALL THE JUDGES OF THIS COURT FOR THEIR CONTINUED SUPPORT AND COMMITMENT TO THIS TRADITION.
I WOULD ALSO LIKE TO GIVE SPECIAL THANKS TO JOHN BAKER FOR HIS TIRELESS EFFORTS AND COUNTLESS HOURS IN ORGANIZING AND ARRANGING THIS MEMORIAL. TODAY WE REMEMBER DANNY KHALOUF WHO WAS TRAGICALLY TAKEN FROM US LAST YEAR. I’M SURE THE WORDS OF MARIA DANTOS WILL FOCUS ON WHAT DANNY DID IN THE TIME HE HAD WITH US AND WILL REMIND ALL OF US WHO DANNY WAS AND JUST WHY SO MANY OF US MISS HIM TODAY.
MS. DANTOS: MAY IT PLEASE THE COURT, FAMILY AND FRIENDS OF DANNY KHALOUF. I STAND BEFORE YOU TODAY COMPLETELY HONORED TO SPEAK ABOUT SUCH AN EXCEPTIONAL HUMAN BEING. OUR WOUNDS ARE
STILL SO VERY FRESH, YET THERE IS MUCH I WISH TO SHARE. SO, IN HONOR OF DANNY, I WILL SIMPLY SPEAK FROM MY HEART.
I WAS DANNY’S COLLEAGUE, ONE OF HIS MANY MENTORS, AND MOST CERTAINLY HIS FRIEND. DANNY’S LIFE WAS ONE OF PROMISE, BOTH FULFILLED AND UNFULFILLED; THE PROMISE OF A LIFE LIVED FULLY, WITH THE BEST THAT THIS LIFE HAS TO OFFER. AS WE THINK OF THE PROMISE THAT WAS LEFT UNFULFILLED, WE CANNOT HELP BUT GRIEVE DEEPLY. HE SHOULD HAVE HAD A LONG AND EXCEPTIONAL CAREER. WE SHOULD HAVE BEEN ABLE TO SHARE IN THE JOYS OF HIS LIFE — HIS MARRIAGE, THE BIRTH OF HIS CHILDREN, AND
SO MUCH MORE. BUT AT THE TENDER AGE OF 27 YEARS OLD, HE WAS VIOLENTLY TAKEN FROM THIS WORLD.
THEN I THINK ABOUT THE PROMISE THAT WAS FULFILLED; FOR AS A MAN, AS A HUMAN BEING, HE WAS
MORE THAN FULFILLED, HE WAS COMPLETE. WHAT HE WAS TO HIS FAMILY, THE COMMUNITY, THE PUBLIC, TO HIS FRIENDS AND COLLEAGUES, HE WAS ALL THAT ANY OF US SHOULD HOPE TO BE.
HE WAS BORN AND RAISED HERE, AND ALL THAT HE NEEDED WAS RIGHT HERE, FOR DANNY DID NOT SIMPLY EXIST AMONG US, HE LIVED FULLY AND LOVED DEEPLY. DANNY WAS BORN ON THANKSGIVING DAY IN
1976. WHAT A GIFT TO BE FOREVER THANKFUL FOR. HIS PARENTS, ELIAS AND NAIFE, AND HIS SISTER SUSAN WERE ALWAYS PROUD OF HIM. HIS MOTHER SAYS HE WAS ALWAYS SMART, ALWAYS GOOD, AND IN 27 YEARS BROUGHT HER NOT ONE DAY OF UNHAPPINESS, ONLY JOY. HE WAS HER BEST FRIEND.
HE WAS RAISED WITH A STRONG FAITH IN THE SYRIAN ORTHODOX CHURCH. HIS FAITH KEPT HIM STRONG.
HE BEGAN AS AN ALTAR BOY AND THEN THE CAPTAIN OF THE ALTAR BOYS. AND AS HE GREW, HE BECAME ACTIVE WITH THE TEEN YOUTH ASSOCIATION. HE WAS A LEADER. AS HE GREW INTO A MAN, HE WAS INVOLVED WITH CHURCH.
COMMITTEES UNTIL HE WAS THE VICE PRESIDENT OF THE PARISH COUNSEL WITH FREDDY CHARLES AS THE
PRESIDENT — ANOTHER MENTOR. IT WAS DANNY ON THOSE SNOWY WINTER MORNINGS WHO WENT EARLY TO THE CHURCH TO SHOVEL SNOW IN HIS SUIT AND HELP THE OTHERS INTO THE CHURCH. IT WAS HIS DREAM TO HELP PEOPLE, THOSE LESS FORTUNATE THAN HIMSELF, AND CHILDREN, ESPECIALLY. ALL OF US
WANT TO HELP, BUT IT WAS DANNY WHO DID. HE GAVE OF HIMSELF TO OTHERS; HIS TIME, DINNERS, MOVIES. HE WOULD MAKE THE TIME FOR PEOPLE. HIS MOTHER TELLS THE MOST POIGNANT STORIES OF A WARM AND LOVING CHILD WITH A GREAT SENSE OF HUMOR. SHE TOLD ME A STORY ABOUT DANNY
WHEN HE WAS 11 YEARS OLD. IT WAS BEFORE HIS BIRTHDAY, AND HE WAS WALKING WITH HIS FATHER WHEN
HIS FATHER ASKED HIM TO TELL HIM WHAT DANNY WANTED FOR HIS BIRTHDAY. HE COULD HAVE ANYTHING HE WANTED, BUT HE HAD TO TELL HIM. DANNY SAID THAT HIS FATHER COULD NOT BUY HIM WHAT HE WANTED, SO HIS FATHER THOUGHT IT WAS BECAUSE IT WAS OVER THE MONETARY LIMIT. DANNY SAID NO, IT WAS SOMETHING THAT COULDN’T BE BOUGHT. HE SIMPLY POINTED TO THE CIGARETTES IN HIS FATHER’S POCKET AND SAID HE WANTED HIM TO QUIT. HIS FATHER SAID, “GO AHEAD, DANNY, TAKE THEM. TAKE THEM, GET RID OF THEM.” AND DANNY SAID, “NO, IT HAS TO BE YOU. YOU MUST DO IT.” SO HIS FATHER TOOK THE PACK, SMASHED THEM INTO THE GROUND AND THAT WAS THE END OF IT. WISE BEYOND HIS YEARS.
DANNY’S FATHER FELL ILL AND DIED WHEN DANNY WAS ONLY 17 YEARS OLD AND THE FAMILY SUFFERED.
DANNY BEGAN COLLEGE AT MUHLENBERG BUT NEEDED A SEMESTER OFF. HE NEEDED TO BE AT HOME TO
TAKE CARE OF HIS MOTHER AND HE NEEDED TO TAKE SOME TIME. THERE WAS SOMETHING MORE IMPORTANT. NAIFE WAS AFRAID THAT HE WOULD NOT RETURN TO SCHOOL, BUT RETURN HE DID, AND HE STILL GRADUATED IN FOUR YEARS A STRONG AND WISE YOUNG MAN. HE WENT OFF TO TEMPLE FOR LAW SCHOOL, AND HE RETURNED HOME ON THE WEEKENDS AND SOMETIMES DURING THE WEEK.
AFTER TRADING IN HIS CAR AND HIS MOTHER’S UNRELIABLE CAR FOR ONE GOOD CAR JUST FOR
HER, HE WOULD TAKE THE BUS HOME. AND WHEN HE WOULD COME, SOMETIMES HIS MOTHER WOULD ASK HIM WHY HE WOULD COME HOME. DANNY SAID IT WAS LIKE A CAR NEEDING GAS. HE NEEDED THE HUGS, KISSES, LOVE AND WARMTH FROM HIS FAMILY. SHE TOLD ME HOW HE WOULD SEE HER SAD AT TIMES AND KNOW THAT IT WAS BECAUSE OF HIS FATHER’S DEATH. HE WOULD SAY TO HER, “I KNOW YOU ARE SAD
ABOUT DAD. SO AM I. BUT I HATE TO SEE YOU SAD. WE HAVE TO BE THANKFUL FOR ALL THAT WE HAVE.” HE WOULD MAKE HER STRONG WITH HIS WORDS. HE COULD BE MISCHIEVOUS AS WELL. AND WHEN HE HAD PROBLEMS, HE WOULD FIND A WAY TO TELL HIS MOTHER BECAUSE HE DID NOT LIE TO HER. AND IF HE DID SOMETHING HE KNEW WAS GOING TO MAKE HIS MOTHER MAD, HE WOULD PREFACE THE TELLING OF THE TRUTH WITH A DIRECTIVE TO HER THAT SHE WAS NOT TO GET MAD.
THEN, OF COURSE, WHEN SHE DID, HE WOULD TURN THE TABLE AND TELL HER THAT SHE WAS NOT SUPPOSED TO GET MAD AND TELL HER THAT SOMEHOW SHE HAD VIOLATED THE RULES; THAT HE WAS THE BOSS. HE WOULD WRESTLE WITH HER AND DO WHATEVER IT TOOK TO GET HER TO LAUGH UNTIL ALL WAS WELL AGAIN. AFTER LAW SCHOOL, HE CAME TO US, TO THE DISTRICT ATTORNEY’S OFFICE. A GREAT HIRING DECISION. DANNY WAS EXCITED ABOUT BEING A PROSECUTOR, AN ASSISTANT DISTRICT ATTORNEY. OUR OFFICE IS LARGE ENOUGH TO PROSECUTE THOUSANDS OF CRIMINAL CASES A YEAR AND YET SMALL ENOUGH TO FORM BONDS THAT ARE FOREVER. THOSE WHO HAVE BEEN THERE KNOW WHAT I AM TALKING ABOUT. WHEN YOU JOIN IN AS DANNY DID AND ARE COMMITTED TO THE PURSUIT OF JUSTICE AS HE WAS, IT IS SIMPLY THE BEST PLACE TO BE.
IF YOU HAVE TO BE SOMEWHERE FOR MORE THAN EIGHT HOURS A DAY, AT LEAST FIVE DAYS A WEEK, THEN THIS IS AS GOOD AS ANY, IF NOT BETTER. WE SHARE OUR LIVES TOGETHER. I HAVE NO STORIES FOR YOU ABOUT HIS LONG CAREER, FOR IT WAS CUT SO VERY SHORT. WHAT I WILL TELL YOU IS THAT THE QUALITIES THAT MADE HIM SUCH AN EXCEPTIONAL YOUNG MAN WOULD HAVE SERVED HIM EQUALLY WELL AS AN EXCEPTIONAL ATTORNEY. ASK ANYONE TO TELL YOU ABOUT DANNY, AND YOU WILL HEAR WORDS SUCH AS HONEST, KIND, PASSIONATE, CARING, GENEROUS, COMPASSIONATE, FUNNY, HARD WORKING, SMART AND LOYAL. HE EARNED THE RESPECT THAT WE ALL HAVE FOR HIM. HE GREETED EACH DAY WITH A SMILE AND LEFT EACH DAY IN THE SAME WAY. YOU KNOW HOW SOMETIMES YOU MAY BE DISTRACTED AS YOU ENTER A ROOM OR BE ON THE PHONE AND NOT QUITE PAYING ATTENTION TO THOSE AROUND YOU?
DANNY NEVER DID THAT. WHEN HE SAW YOU, HE GREETED YOU WITH A GOOD MORNING AND THAT SMILE THAT COULD MELT THE COLDEST SOUL AND LIGHTEN YOUR WORST MOOD. HE WAS SO YOUNG AND SO BEAUTIFUL. IT WAS EASY TO SEE HIS SPIRIT. WE ALL SAW IT AND THAT’S WHY HE HAD SO MANY MENTORS.
WE ALL WANTED TO TEACH HIM AND HE WAS SO EAGER TO LEARN. WE WANTED TO MENTOR HIM,
SHOW HIM OUR WAY. BUT WHAT I HAVE SEEN IS THAT IN TRUTH, IT WAS HE WHO TAUGHT US. WE SHARED OUR LIVES, LOVE, AND OUR PHILOSOPHIES. WE CONTINUE TODAY TO HOLD ONTO THINGS
FROM DANNY: NOTES HE PUT IN A FILE, FOR IT IS HIS HANDWRITING, E-MAILS HE SENT, FUNNY THINGS TO MAKE OTHER PEOPLE FEEL BETTER. EVERYONE LOVED DANNY, WHICH IS NO SMALL ACCOMPLISHMENT GIVEN THE VARIED PERSONALITIES IN OUR OFFICE. AS YOU WOULD EXPECT, WE SOMETIMES BICKER AND FIGHT OVER INCONSEQUENTIAL THINGS AND SOMETIMES OVER VERY IMPORTANT MATTERS AS WELL. BUT DANNY’S DEATH HAS BEEN A UNIFYING FORCE IN THAT SOMEHOW THE SMALL THINGS DON’T REALLY MATTER SO MUCH. I REMEMBER THE FIRST TIME I SAW DANNY IN THE COURTROOM. HE HELPED ME WITH AN EXERCISE WE DO WITH THE ALLENTOWN POLICE CADETS, A CLASS IN COURTROOM TESTIMONY AND DEMEANOR. JUDGE BANACH WAS WITH US THEN, AND SHE WAS ACTUALLY PLAYING THE ROLE OF THE JUDGE. I WAS COORDINATING AND DANNY WAS PLAYING THE ROLE OF THE DEFENSE ATTORNEY AND CROSS-
EXAMINING A CADET. AS WE WATCHED, BOTH JUDGE BANACH AND I LOCKED EYES FOR WE WERE SEEING THE SAME THING. HE WAS STRONG, PASSIONATE, QUICK ON HIS FEET AND REALLY, REALLY GOOD. I REMEMBER OUR DISCUSSION ABOUT IT AFTER AND HOW IMPRESSED WE BOTH WERE WITH HIS PROMISE.
I’LL TELL YOU SOME OF THE REMEMBRANCES FROM HIS COWORKERS. HE WAS DESCRIBED AS A GENTLEMAN’S GENTLEMAN. HE WAS THE YOUNG MAN WHO ALWAYS HELD THE DOOR OPEN AND LOOKED YOU IN THE EYE
WHEN HE SHOOK YOUR HAND. HE RARELY HAD A BAD DAY, AND WHEN HE DID, HE GOT OVER IT QUICKLY AND WITH GREAT HUMOR. TO KNOW DANNY WAS TO KNOW WHAT WAS IMPORTANT TO HIM — HIS FAMILY. ONE FRIEND CALLED HIM “D-MONEY” AND SAID HE WAS AS DEPENDABLE AS CASH, FOR HE CARED DEEPLY ABOUT A PERSON. AND IF YOU HAD A PROBLEM, IT BECAME HIS PROBLEM. WE TRY TO SURROUND OURSELVES WITH PEOPLE WHO HAVE QUALITIES WE ADMIRE, AND WE ALL CHOSE DANNY. HE MADE US EACH FEEL SPECIAL. SOME REMEMBERED THAT HE WAS ALWAYS IN SEARCH OF THE PERFECT CHEESESTEAK. AND WHO COULD
FORGET ALL OF THE EATING CHALLENGES THAT HE SO EASILY WON, FOR HE WAS PASSIONATE ABOUT HIS FOOD AS WELL. AND I CANNOT MENTION PASSION ONCE MORE WITHOUT HIS GREATEST PASSION. I APOLOGIZE FOR BRINGING IT UP TODAY, BUT IT WAS THE EAGLES.
HE LOVED THE EAGLES. HE LOVED THEM SINCE HE WAS THREE OR FOUR YEARS OLD AND HAS MANAGED TO TURN MANY, MANY FAMILY MEMBERS INTO FANS AS WELL. NO WAY IN HIS MIND COULD HE EVER EVEN GIVE A SECOND’S THOUGHT TO THEIR NOT WINNING; OF COURSE THEY WOULD WIN. AND AFTER ALL THE HYPE FROM DANNY WHEN THEY WOULD LOSE, IT WAS A VERY HARD MONDAY AT WORK, FOR HE GOT WHAT
HE HAD COMING ON THOSE DAYS. BUT HE WAS THE YOUNGER BROTHER. HE WAS DESCRIBED AS WISE BEYOND HIS YEARS. HE AND A COWORKER BOTH HAD TO GO DOWN TO PHILADELPHIA FOR A SUPERIOR COURT ARGUMENT, AND THEY DID NOT KNOW THAT THE OTHER WAS GOING. THEY GREETED WHEN THEY ARRIVED, AND HE ASKED HOW SHE HAD GOTTEN THERE. SHE HAD TAKEN THE TRAIN. HIS ARGUMENT WAS FIRST. HERS WAS LAST. WITHOUT PRODUCTION, HE SIMPLY WAITED FOR HER ALL DAY AND ANNOUNCED THAT HE WOULD BE DRIVING HER HOME SO THAT SHE WOULD NOT HAVE TO TAKE THE TRAIN.
ANOTHER MEMORY: A COWORKER GOING OUT ON MATERNITY LEAVE, A THOUGHTFUL GIFT JUST FOR HER.
AND HIS WORDS, “WHAT WILL I DO WITHOUT YOU HERE?” A GENTLEMAN. A LEADER. FOR ME, IT WAS USUALLY AT THE END OF THE DAY WHEN THINGS WERE WINDING DOWN AND WE READIED FOR THE NEXT. HE WOULD COME BY FOR A TALK. WE SPOKE OF HIS HOPES, HIS DREAMS, HIS ASPIRATIONS. HE ASKED MY
ADVICE AND SOMETIMES HE TOOK IT. HE COULD READ PEOPLE. HE KNEW IF THINGS WERE WRONG WITH JUST A LOOK, AND HE WANTED TO HELP ALWAYS. AND THEN IT WAS FRIDAY. WE SAID OUR GOOD-BYES FOR THE WEEKEND AS USUAL. FOR SOME UNKNOWN REASON, ANOTHER FRIEND WENT IN AND HUGGED AND KISSED HIM GOOD-BYE. THEN SATURDAY MORNING, THE PHONE RANG AND CONTINUED TO RING THROUGHOUT THE DAY AS IT SHATTERED THE PEOPLE AROUND ME. WE ENTERED HIS OFFICE AND MOST UNEXPECTEDLY WOULD CATCH HIS SCENT. WE SAW HIS TREASURES, HIS FAMILY PHOTOGRAPHS. THE CANDLES WERE LIT AND THE FOUR ROSES LAY ON HIS DESK. AND THEN NAIFE CAME TO US. TO KNOW HIS
MOTHER IS TO KNOW DANNY. WITH GRACE AND STRENGTH, SHE CAME ONLY WEEKS AFTER HIS DEATH. AS WE GATHERED IN DANNY’S OFFICE, SHE TOLD US STORIES; STORIES THAT WARMED OUR HEARTS AND MADE US LAUGH AND CRY. I HONESTLY DO NOT KNOW HOW SHE DID IT. BUT AFTER BEING WITH HER, IT WAS CRYSTAL CLEAR HOW HE WAS ABLE TO BE THE MAN THAT HE WAS.
I LEAVE YOU WITH NO FAMOUS POEMS, JUST THESE WORDS: THE WORLD IS A BETTER PLACE BECAUSE DANNY WAS HERE. HIS LEGACY DOES LIVE ON THROUGH US EACH DAY THAT WE REMEMBER THAT SMILE, HEAR HIS WORDS AND REMEMBER WHAT WE HAVE LEARNED.
TO HIS FAMILY, WE THANK YOU FOR SHARING HIM WITH US. WE LOVED HIM WELL. TO HIS FRIENDS, ALTHOUGH WE WILL MISS HIM FOREVER, HE ENRICHED OUR LIVES AND WE ARE BETTER FOR HAVING HIM COUNTED AS OUR FRIEND.
TO THOSE OF YOU WHO DID NOT KNOW HIM, I HOPE YOU’VE LEARNED A BIT ABOUT HOW VERY SPECIAL HE
WAS AND TO DANNY. WE WELCOMED YOU IN OUR USUAL WAY — SOME CAUTIOUSLY, SOME GUARDED, SOME
OPENLY WARM WITH AN EMBRACE — AND EVER SO QUIETLY, YOU BECAME A PART OF US. WE KNEW YOU NOT AS A CHILD BUT AS A MAN. ALL THAT YOUR PARENTS HAD TAUGHT YOU AND ALL THAT YOU HAD BECOME, WE WERE BLESSED.
THE GATHERINGS ARE HARD NOW, FOR WE MISS YOU. BUT VIVID AS ANY ART IS THE MEMORY OF ALL THAT
YOU GAVE US. AND LIKE THE DOVES WE SAW SOAR ABOVE US AT YOUR GRAVE, WE KNOW YOU ARE WITH US. WE WILL MISS YOU FOREVER.
THE COURT: THANK YOU, MS. DANTOS. I
KNOW THAT WAS A PERSONALLY DIFFICULT TASK THAT WAS GIVEN TO YOU, BUT YOU HANDLED IT EXTREMELY WELL, AS I EXPECTED YOU WOULD. DANNY KHALOUF WAS ASSIGNED TO MY COURTROOM, AND I WILL ALWAYS HAVE FOND MEMORIES AS I WATCHED HIM GROW IN THE LAW. WE ALL MISS HIM ON
THIS COURT. WE ARE SADDENED BY THAT LOSS.
I WANT TO THANK THE BAR ASSOCIATION OF LEHIGH COUNTY FOR CONTINUING THIS WONDERFUL
TRADITION; THANK JOHN BAKER, THE CHAIRMAN OF THE BAR ASSOCIATION COMMITTEE FOR THE WORK THAT HE DID; THANK MARIA, AGAIN, FOR HER WONDERFUL REMARKS.
IS THERE ANYONE ON THE COURT WHO WISHES
TO HAVE ANY REMARKS AT THIS TIME?
(WHEREUPON, THERE WAS NO RESPONSE.)
THE COURT: IF NOT, THEN WE WILL ADJOURN THIS CEREMONY,AND WHEN WE DO SO, IT WILL BE OUT OF RESPECT FOR OUR DEPARTED COLLEAGUE, DANNY KHALOUF, ESQUIRE.
